The Divorce Process in Davidson County

Knowing what lies ahead can make an already difficult situation feel more manageable. Nashville-area divorce cases are filed with the Davidson County Circuit Court, and the process follows a defined path from the initial complaint through the final decree. Tennessee law imposes mandatory waiting periods before a divorce can be finalized: at least 60 days for cases without minor children and at least 90 days for cases involving minor children.

The process begins with the divorce complaint, the initiating filing that opens the case. After service on the other spouse and satisfaction of the applicable waiting period, the case moves toward resolution, either by agreement or through court proceedings. Even in an uncontested divorce, where both spouses have agreed on all terms, a judge must review and approve the agreement before the divorce becomes legally final. Tennessee generally requires that at least one spouse have lived in the state for six months before filing.

Uncontested Divorce

When both spouses agree on property division, parenting arrangements, and support, the process can move more efficiently. Uncontested divorces that satisfy Tennessee’s residency and waiting period requirements can sometimes resolve within a few months, though the timeline always depends on case-specific circumstances and court scheduling.

Contested Divorce

When spouses can’t reach agreement on one or more issues, a contested divorce moves through additional stages: discovery, possible mediation, and, if necessary, a hearing or trial. Contested cases generally take longer, and the timeline can vary considerably based on what’s in dispute and how the case is managed.

Alimony & Spousal Support in a Nashville Divorce

Spousal support is one of the more consequential financial issues in a Tennessee divorce, and one of the most frequently misunderstood. Tennessee law recognizes four types of alimony, each with a distinct purpose:

  • Rehabilitative alimony: supports a spouse who needs time or resources to develop earning capacity
  • Transitional alimony: helps a spouse adjust to changed financial circumstances
  • Periodic alimony: provides for ongoing support needs
  • Lump sum alimony: applies when a fixed total payment is appropriate

Courts generally award alimony when one spouse has the ability to pay and the other has a demonstrated need for support. The length of the marriage, each spouse’s income and earning potential, and the standard of living established during the marriage can all influence whether support is awarded and in what amount.
